This Privacy & Cookie Policy explains how DISC Spine Institute and DISC Clinic, PLLC (“DISC,” “we,” “us,” or “our”) collect and use information when you visit our website at www.discspine.com (the “Site”). It describes the limited information our marketing website gathers, the cookies and similar technologies we use, and the choices you have.
This policy applies to our public marketing Site only. It does not govern the patient intake forms, patient portals, or medical records systems we use to provide care — those handle protected health information separately, as described in Section 3.

Information We Collect on This Site

Our Site is designed to share information about our practice and to let prospective and current patients contact us. We collect two kinds of information:

Information you provide: If you complete a contact or appointment-request form, we collect your name, email address, and phone number so we can follow up with you. We ask only for basic contact details on the Site; any medical or insurance information is gathered later, by our staff, during a phone call or through our secure patient systems.

Information collected automatically: Like most websites, our Site automatically records limited technical information through cookies and similar technologies — such as your IP address, browser type, device type, the pages you view, and how you arrived at our Site. This helps us understand how the Site is used and improve it. See Section 4 for details.

Health Information Is Handled Separately

Our marketing Site is not intended to collect protected health information (“PHI”). The contact forms on this Site ask only for your name and contact details, not for details about your health condition or insurance.

When you become a patient, the health and insurance information you provide — for example, through our patient intake forms or during your visit — is collected and protected under the Health Insurance Portability and Accountability Act (“HIPAA”) and is governed by our Notice of Privacy Practices, not by this policy. Our patient intake forms are hosted on a separate, secure healthcare platform. If you have questions about your health information, please contact our office directly.

Cookies & Similar Technologies

Cookies are small text files placed on your device that let a website recognize your browser and remember certain information. We and our service providers use cookies and similar technologies (such as tags and pixels) to operate the Site, measure how it performs, and support our advertising. We group them into three categories:

Essential cookies

These are necessary for the Site to function and to keep it secure. For example, our Site uses Google reCAPTCHA to protect our forms from spam and abuse. These cannot be switched off through our cookie controls.

Analytics cookies

These help us understand how visitors use the Site — which pages are viewed, how people navigate, and where traffic comes from — so we can improve it. We use Google Analytics for this purpose. Google Analytics collects information such as your IP address and pages visited and processes it on our behalf.

Advertising cookies

These help us measure the effectiveness of our advertising. We advertise our practice through search ads on Google Ads and Microsoft (Bing) Ads, which appear based on the keywords people search — not based on your individual browsing history. We use conversion tracking to understand which ads lead visitors to contact us, so we can improve our advertising. We do not use remarketing or retargeting, and we do not build advertising profiles to follow you with ads across other websites based on your visit to our Site.

Third-party content

Some pages include content from third parties — such as embedded YouTube videos and links to our social media pages (Facebook, Instagram, X, YouTube). These providers may set their own cookies when you interact with that content. Their use of information is governed by their own privacy policies.

How We Share Information

We do not sell your personal information. We share the limited information described in this policy only as follows:

• Service providers: With service providers who help us operate the Site and our advertising — for example, the analytics and advertising providers named above (Google, Microsoft) — who process information on our behalf.
• At your direction: If you ask us to, or direct us to send your information somewhere, we will act on that request.
• Legal requirements: We may disclose information if required by law, subpoena, or other legal process, or to protect the rights, safety, or property of DISC, our patients, or others.
  Health information you provide as a patient is shared only as permitted under HIPAA and our Notice of Privacy Practices — not under this policy. See Section 3.

Your Choices

• Browser controls: Most browsers let you block or delete cookies through their settings. If you block essential cookies, parts of the Site may not work properly.
• Analytics opt-out: You can opt out of Google Analytics across websites by installing the Google Analytics Opt-out Browser Add-on.
• Advertising choices: Although we do not use remarketing, you can manage personalized advertising generally through Google Ads Settings, Microsoft’s ad settings, and industry opt-out pages such as the Digital Advertising Alliance (optout.aboutads.info) and Network Advertising Initiative (optout.networkadvertising.org).

Do Not Track & State Privacy Signals

Some browsers offer a “Do Not Track” setting or a Global Privacy Control signal. Because there is not yet a common industry standard for responding to these signals, our Site may not respond to all of them. We describe the opt-out choices available to you in Section 6.

Children’s Privacy

Our Site is intended for adults and is not directed to children under 18. We do not knowingly collect personal information from children under 18 through the Site.

Changes to This Policy

We may update this policy from time to time. When we do, we will revise the “Last Updated” date above. We encourage you to review this policy periodically.

This site contains links to third-party sites for your convenience. Although we try to link only to sites that share our high standards and respect for privacy, DISC Spine Institute is not responsible for the content of those sites. You access those sites and their services at your own risk. The links do not indicate an endorsement by DISC Spine Institute.

Disclosures

Dr. Valente and Dr. Indresano operate their separate practices within DISC Spine Institute. Dr. Mark Valente operates his practice through Renaissance Neurodiagnostics, PA, Blue Star Medical Management, LLC and Movement Orthopedics, PLLC. Dr. Andy Indresano operates his practice through DISC Clinic, PLLC and Streamline Medical Management, LLC. Your physician’s services will be billed through their respective practices entities.

Dr. Mark Valente and/or Dr. Andrew Indresano have a direct or indirect contractual relationship with, or ownership interest in, the following health care professional(s) or facility(ies), which may include management companies, laboratories, pharmacies, neuromonitoring companies, imaging companies, medical device distributorships/manufacturers, first assist companies, anesthesia companies, ambulatory surgery centers, and/or hospitals. Dr. Mark Valente and/or Dr. Andrew Indresano have a direct or indirect contractual relationship with or ownership interest in, but is not limited to; DISC Clinic, PLLC, Blue Star Medical Management, PLLC, Ridgeline Medical Management, PLLC, AAI Investment Holdings, LLC, Movement Orthopedics, PLLC, MEG Healthcare, Inc., Equinox Clinic, PLLC, Equinox Spine, PA, Evolution Spine, LLC, Gemini Medical Consulting, LLC, Methodist Hospital for Surgery, Montage Monitoring, PLLC, Monticello Diagnostic Imaging, LP, Nizuc Care, PLLC, Otway Medical Holdings, LLC, Parkway Surgical & Cardiovascular Hospital, Preston Surgery Center, LLC, and Surgical Safety, PLLC and may benefit by referring me to these health care professionals or health care facilities. You will not be treated differently by Dr. Valente, Dr. Indresano, or any other provider at DISC Spine Institute, DISC Clinic, or any of its affiliates if you choose to obtain health care services from an alternative provider or at an alternative facility.

SMS Texting Services Terms and Conditions

This SMS Texting Services provision is applicable when You have subscribed and expressly consented to receive text messages from Us. By subscribing and providing such consent, You have granted Us express permission to send automated text messages to the enrolled mobile phone number(s) through Your wireless phone carrier unless and until such permission is revoked in accordance with these Terms and Conditions.

When You opt-in to SMS Texting Services, We will send You a text message to confirm Your signup.

We offer SMS Texting Services to provide information or resources on topics including, but not limited to the following:

1. Operational alerts/reminders such as appointment reminders, intake, billing/payment
2. Health-related information provided is not meant to replace professional medical advice and does not establish a patient-provider relationship

Text messages will vary in frequency, by texting program. As part of enrollment in an SMS Texting Service, You may send the text message “HELP” to Us for assistance. Additionally, You may opt-out of an SMS Texting Service by replying “STOP” from Your mobile phone. After You send the text message “STOP” to Us, We will send You a text message to confirm that You have been unsubscribed. After this, You will no longer receive text messages from Us. If You want to join again, You must enroll as You did the first time and We will start sending text messages to You again. Text messages will be sent using an automatic dialing system to the mobile phone number provided to Us.

Operational information provided is valid only at the time the text message is sent and may change at a later time.

Age restrictions apply to SMS Texting Services. To participate, You must be 18 years of age or older and own and control the mobile phone number provided to Us. Individuals between the ages of 14 and 18 must have parental consent. Individuals between 14 and 18 years of age who do not have parental consent, or individuals under 14 years of age, must unsubscribe from the SMS Texting Services.

You must immediately notify Us if Your mobile phone number changes. We are not liable for any communication or transmission of information via text message which occurs as a result of a change to a mobile phone number that is not reported. Using password-protected mobile devices and enabling encryption, if available, is recommended.

Depending on the SMS Texting Service that You have enrolled in, You may receive marketing messages. We are committed to building Your trust and confidence by promoting and complying with the use of business practices that help protect the privacy and the security of You and Your data.

If You are dissatisfied with the SMS Texting Services or with these Terms and Conditions, Your sole and exclusive remedy is to discontinue enrollment in the SMS Texting Services.

We do not guarantee the successful delivery of text messages. Messages sent via text may not be delivered if the mobile phone number is not in range of a transmission site, or if sufficient network capacity is not available at a particular time. Even within a coverage area, factors beyond the control of wireless carriers may interfere with message delivery, including Your equipment, the terrain, and proximity to buildings, foliage, and weather. We will not be liable for losses or damages arising from (a) non-delivery, delayed delivery, or misdirected delivery of a text message; (b) inaccurate or incomplete content in a text message; or (c) use or reliance on the contents of any text message for any purposes.
